SAVE KERALA and Mullaperiyar Dam

Save Kerala is destined to fight against all injustice. Mullaperiyar River was an artery of Kerala. It originates from Sivagiri in the Western Ghats and flows through almost middle of Kerala providing abundant water all over Kerala through its thousands of small streams and channels. The flow of this great river was curtailed by constructing a gravity dam in the name and style of Mullaperiyar Dam. This obstruction in the natural flow of a river itself is an injustice towards nature. The result is drying up of all the small streams and channels relating to this great river. This construction spoiled the agricultural activities of Kerala to a greater extent. It spoiled the flora and fauna of the region. It gives a negative impact on the economy of Kerala. It was a water resource to all other 43 rivers in Kerala. The neighbouring state of Tamil Nadu is getting 7250 Million Rupees every year from our water. We get only 1 Million per annum. This too is a grave injustice towards the people of Kerala. The dam is situated in the territory of Kerala, but the Government of Kerala have no power with regard to the dam. A portion of land within the territory of Kerala is controlled by our neighbouring State. It is an injustice to the Federal Constitution of India. The 1886 Lease Deed was created between the Government of His Highness the Maharaja of Travancore and the Right Honourable the Secretary of State for India in Council under the British. The Maharaja of Travancore was forced to sign this agreement because his Kingdom was a vassal State under the British. This too is an injustice towards the people of Kerala. Therefore we have decided to fight against all these injustices under the banner of “SAVE KERALA”, a Human Rights Organisation.

In December 2017, Adv. Russel Joy as petitioner filed a Writ Petition (No. 878/2017) before the Honourable Supreme Court of India, praying for the fixation of the date of decommissioning of the Mullaperiyar Dam and also for giving compensation to the people of Kerala if any untoward incident happens during this process. The Honourable Supreme Court of India realising the danger caused by this century-old deteriorating dam, directed the Government of India, the Government of Tamil Nadu and also the Government of Kerala to constitute three disaster management committees to safeguard the life and property of the people of Kerala. This was a historical judgment in favour of Kerala after 1941. In 1941, Sir C.P. Ramaswamy Iyer has obtained an order in favour of Travancore. Secondly, during the time of the flood, the Government of Kerala has written a letter to Tamil Nadu praying to reduce the water level from 142 ft to 139 ft. This request was refused by the State of Tamil Nadu in a most barbaric and adamant way. Again, Adv. Russel Joy has approached the Honourable Supreme Court of India with a petition to reduce the water level from 142 ft to 139 ft. That petition was also allowed by the Honourable Supreme Court of India. This was the second victory of the people of Kerala after the year 1941.

This struggle is continuing; our mission is to decommission the Mullaperiyar Dam and to construct a new dam using the most advanced technology to safeguard the life and property of the people of Kerala.
